2. Our Store and Shopify

Our online store is operated using technology provided by Shopify.

Shopify provides e-commerce infrastructure that allows us to display products, process orders, facilitate payments, and provide related online services.

Your contract for the purchase of CloudSoft products is with CloudSoft LLC, unless expressly stated otherwise.

Shopify and other service providers may separately apply their own terms and privacy policies to services they independently provide.

3. Products and Product Information

We make reasonable efforts to accurately display and describe our products, including:

  • Product characteristics

  • Materials

  • Sizes

  • Dimensions

  • Intended use

  • Colors

  • Pricing

  • Product photographs

  • Availability

However, display settings, lighting, photography, manufacturing variations, product revisions, and device settings may cause minor differences between images displayed online and the physical product received.

Reasonable manufacturing variations that do not materially affect the product's intended functionality do not necessarily constitute defects.

We reserve the right to update product descriptions, specifications, packaging, materials, configurations, and designs when reasonably necessary, provided that such changes do not materially reduce the functionality of an already purchased product in a manner prohibited by law.

Nothing in this section limits rights relating to materially misdescribed, defective, unsafe, or non-conforming goods.

4. Product Availability

All products are subject to availability.

We may:

  • Limit quantities available for purchase;

  • Limit sales to particular geographic regions where legally permitted;

  • Discontinue products;

  • Modify inventory;

  • Refuse unusually large quantities;

  • Restrict purchases reasonably suspected of being for unauthorized resale.

Adding a product to a shopping cart does not reserve inventory.

An order confirmation acknowledging receipt of your order does not necessarily mean that the order has been accepted or that the product remains available.

If a product becomes unavailable after you place an order, we may cancel the affected portion of the order and refund the applicable amount.

7. Pricing

Prices displayed through our Services are subject to change before an order is placed.

CloudSoft LLC does not control charges imposed directly by foreign government authorities.

11. Bundles and Multi-Item Offers

Products sold as bundles, kits, multi-buy offers, or promotional packages may be priced based on purchasing multiple items together.

If only part of a bundled purchase is returned, the refund calculation may reflect the actual promotional allocation applied to the original transaction, as explained in our Return and Refund Policy.

We will not retroactively impose undisclosed penalties or charges.

Responsibility for goods during delivery will be determined in accordance with applicable law.

Nothing in these Terms transfers delivery risk to a consumer earlier than permitted by mandatory consumer protection law.

Where legally permitted and where goods are delivered to a carrier independently selected and arranged by the customer rather than one offered by CloudSoft LLC, different rules may apply.

14. Returns, Refunds, and Exchanges

Returns, refunds, exchanges, and our voluntary money-back guarantee are governed by our Return and Refund Policy, which forms part of these Terms.

Where our Return and Refund Policy provides protections more favorable than the minimum required by law, the more favorable published policy will apply according to its terms.

Nothing in these Terms limits statutory rights relating to defective, unsafe, damaged, incorrectly supplied, or misdescribed products.

15. Order Cancellations

Contact us as soon as possible if you wish to cancel or modify an order.

We may be unable to stop an order after processing or shipment has begun.

Where cancellation before shipment is operationally possible, we will make reasonable efforts to accommodate the request.

Any inability to intercept a shipment does not eliminate a statutory cancellation or withdrawal right that applies under mandatory law.

Nothing in these Terms eliminates a right or remedy that applicable federal or state law makes non-waivable.

Because CloudSoft LLC serves customers across multiple jurisdictions, these Terms do not impose a choice of law or forum that would unlawfully deprive a consumer of mandatory protections available in the consumer's jurisdiction.

40. Governing Law

These Terms and transactions involving CloudSoft LLC will be governed by the laws that are legally applicable to the relevant transaction, without giving effect to a contractual choice that would unlawfully deprive a consumer of mandatory protections.

Where parties are legally permitted to agree on another governing law or forum, a separate written agreement may apply.

41. Severability

If any provision of these Terms is determined to be unlawful, void, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed to the minimum extent necessary.

The remaining provisions will continue in effect.

42. No Waiver

Our failure to immediately enforce a provision of these Terms does not automatically waive our right to enforce that provision later.

This section does not extend a limitation period or revive a right that has legally expired.
